Job Summary

The Minnesota Department of Human Services (DHS), Office of Inspector General (OIG) – Legal Division is hiring two attorneys to be agency-wide experts in each of the following bodies of law:

  • Home and Community-Based Services (HCBS) – all state and federal laws and caselaw impacting regulation and enforcement for HCBS licensing.
  • Substance Use Disorder Treatment (SUDT) and Mental Health Programs – all state and federal laws impacting regulation and enforcement for SUDT, Mental Health programs and Children’s Residential Facilities licensing and certification.

Each of these areas is rapidly evolving in our State. We need experienced, thoughtful counsel who are able to apply a deep level of substantive legal knowledge to the primary task of providing strategic legal advice and litigation oversight in each of the above areas. Each position will be the agency-wide substantive expert in their area of specialty and will advise OIG leadership and legal consultation as needed to OIG and agency leadership when other OIG or agency areas are navigating space that intersects with the above two areas of expertise. Each position will also be at the forefront of advising on complex, high profile legal matters.

Responsibilities include but not limited to:

  • Provide legal research and advice on applicability and interpretation of all aspects of regulation related to emerging issues in these areas.
  • Provide legal analysis and legal advice with respect to the application of state and federal statutes, rules, and case law to fact situations under review or investigation by assigned business units.
  • Conduct legal analysis and provide legal advice and practical assistance to Department policy staff and General Counsel’s Office in development of grant programs to assure inclusion of program integrity aspects that are enforceable by Department staff in incumbent’s assigned business units.
  • Advise, negotiate, and draft professional and technical contracts, master contracts, work order contracts, annual plans, amendments to contracts, requests for proposals, interagency agreements, and joint powers agreements (collectively herein, “contracts”) as needed for assigned business units.
  • Serve as the Minnesota Government Data Practices designee for assigned business units.
  • Provide legal analysis, legal advice, and practical assistance to assigned business units within the Department with regard to all aspects of rulemaking.

Qualifications

Minimum Qualifications

  • JD degree from an ABA accredited law school;
  • Current license and in good standing to practice law in Minnesota;
  • At least 5 years’ experience as a practicing attorney in an area of law related to these positions.

Experience must demonstrate the following:

  • Strong legal research, analysis, and writing skills;
  • Ability to effectively communicate complex legal concepts to persons with non-legal backgrounds;
  • Ability to develop strong legal advice and litigation strategies independently;
  • Ability to build and maintain good working relationships with internal and external stakeholders;
  • Ability to provide legal advice to executive leadership on diverse and complex human services and data privacy matters; and
  • Ability to provide legal advice that crosses over multiple areas of law, specifically, any of the specialties list above and their intersection with civil law or other administrative law specialties such as data practices and administrative law procedure.

Preferred Qualifications

  • Subject matter expert in administrative law related to the work of the assigned business areas, and other areas of law related to Department of Human Services (DHS) programs.
    • Related law includes:
      • Contract law
      • Federal laws impacting the work of the assigned business units, including but not limited to the False Claims Act, Medicaid, including Medicaid waivers, Drug Abuse Office and Treatment Act, Consolidated Appropriations Act, Substance Use Prevention, Treatment, and Recovery Services Block Grant Act, Criminal Justice Information Services, and Limit on Receiving Public Funds.
      • Government data practices law.
  • Demonstrated ability to integrate complex non-legal factors to develop legal advice and strategies in high profile matters.
  • Demonstrated strong emotional intelligence, strategic leadership, change management, and diversity equity and inclusion skills are essential components for effective job performance.
  • Demonstrated ability to communicate effectively with a large and varied constituency, including legislators and legislative staff, the Attorney General’s Office, state local and federal agencies, professional and advocacy groups, as well as the general public.
  • Demonstrated ability to maintain composure and convey competency, equanimity, and collaboration in stressful situations.
  • Identify common ground for parties with varied interests and build consensus toward solutions.
  • Analytical skills to assimilate information and apply it in strategic, decision-making processes.
  • Facilitate conflict resolution and ensure competing interests are appropriately balanced.
  • Variety of experiences working effectively with others from different backgrounds and cultures.
